NSCLC Report: Mo. Nursing Home Admissions Agreements

A recent NSCLC study of nursing home admissions agreements in Missouri found misleading statements and attempts to reduce nursing home responsibility to care for residents.


Admission agreements for Missouri nursing homes can mislead residents and their family members, according to a new report from the National Senior Citizens Law Center (NSCLC). The full report will be released on Dec. 17-18 at news conferences in St. Louis, Columbia and Kansas City.

NSCLC, a national non-profit devoted to protecting the legal rights of older Americans, examined 175 admission agreements from Missouri nursing homes and found that the agreements frequently conflicted with relevant state and federal law and/or misled residents and family about a facility’s legal requirements. Some provisions, although arguably legal, waived or limited the nursing home’s obligation to provide adequate care.

The admissions agreements, which nursing home residents or their family members sign when a resident first is admitted to the nursing home, have particular importance because they tend to set expectations about the facility’s standard of care and the family’s responsibilities.

The report, Think Twice Before Signing: Improper and Unfair Provisions in Missouri Nursing Home Admission Agreements is accompanied by a consumer guide that can be used by consumers, family members, nursing homes and others to identify problems and resolve or prevent disputes.
